  • A TEMPORARY EMPLOYMENT PASS in Malaysia is for those between the ages of 18 and 45 and from certain approved countries. To work as a Foreign Domestic Helper, you must be a woman between 21 and 45 years of age. No specific qualifications are considered highly skilled.

Requirements

  • Hiring company is registered with the Expatriate Services Division (ESD)
  • Employees’ Basic monthly salary is at least RM 10,000
  • Up to 5 years of valid employment contract in Malaysia
  • Proof of highest educational certificate or equivalent working experience
  • Spouse and Children (below 18 years old) are eligible for Dependent Pass
  • Renewable based on certain requirements

Employment Pass II

Requirements

  • Hiring company is registered with the Expatriate Services Division (ESD)
  • Employees’ Basic monthly salary is between RM 5,000 and RM 9,999
  • Maximum 2 years of valid employment contract in Malaysia
  • Proof of highest educational certificate or equivalent working experience
  • Spouse and Children (below 18 years old) are eligible for Dependent Passes
  • Renewable based on certain requirements

Employment Pass III

Requirements

  • Hiring company is registered with the Expatriate Services Division (ESD)
    Employees’ Basic monthly salary is between RM 3,000 and RM 4,999
  • Maximum 1 year of valid employment
    Proof of highest educational certificate or equivalent working experience
  • Spouse and Children (below 18 years old) are NOT eligible for Dependent Pass
  • Can be renewed 2 times at most (subject to review)
  • Needs approval from the KDN (in Malaysian Ministry of Home Affairs)

Professional Visit Pass (PVP) / Training Pass

Requirements

  • Your Malaysia based company is registered with the Expatriate Services Division (ESD)
  • PVP’s allow for short term Assignments or Internships for learning on-the-job or to provide temporary technical support to your customers in Malaysia
  • Professional Visit Passes can also be used for staff to give training or to receive training with a company located in Malaysia
  • PVP Passes can last for a period of up to 12 months

Residence Pass-Talent By Talentcorp

Requirements

  • Applicants need to have worked in Malaysia for at least 3 years
  • Holds a valid Employment Pass at the time of application
  • Holds a PhD /Masters/ Degree or Diploma in any discipline from a recognized university or a professional / competency certificate from a recognized professional institute
  • Possesses at least 5 years of total work experience
  • Earns a basic monthly salary of at least RM15,000
  • Has an income tax file number in Malaysia and has paid income tax for at least 2 years

Investor Pass

Requirements

  • Business visitors or foreign investors who fall under any of the following three (3) categories are eligible to apply for the Investor Pass:
    i. New Investor: Potential investors who have not had any investment record in Malaysia.
    ii. Investor in Pipeline: Potential investors who have been identified as interested in making investments in Malaysia, are currently in negotiations with the Malaysian Government, or have applied to MIDA for project approvals.
    iii. Existing Investor: Investors who have investment records in Malaysia and SSM-registered companies but are not under the employment of the company or any companies in Malaysia. Note: The Existing Investor category is only available for Manufacturing and Selected Services sectors under MIDAs purview. Sectors governed by other agencies will be available in Phase 2

  • NOT eligible to convert to an Employment Pass

Guardian Pass

  • Immediate parent of a person studying in Malaysia

Requirements

  • A pass for Expatriates’ children who are studying at an International School in Malaysia
  • A Multiple Entry Visa (MEV) will be issued for ease of travel between Malaysia and their home country

How can I get a work permit in Malaysia?

Firstly you need to have a job offer and a sponsoring company to apply for a work permit. What is the difference between a work permit and an employment pass?

Work permit is a general term used for all kinds of work visas in Malaysia. Work permit for general labour workers are different from work permit for professionals. Employment pass is specifically for professionals / expats working in Malaysia.

Can a spouse with a Dependent Pass work in Malaysia?

No, dependent pass holders are not allowed to work in Malaysia. If you would like to work in Malaysia, you would need to cancel your dependent pass and apply for an employment pass.

What are the reasons for rejection of the employment pass in Malaysia?

There are multiple regulations that must be met before an employment pass can be issued and certain things can cause an application to be rejected. Extra care must be taken because incomplete application forms, failure to provide certified copies of documents, salary profile does not meet the requirements or a poor letter of justification by the employer can cause rejection of your application. Other factors like a full quota, outdated records and skills that can be locally sourced can also cause this to happen.

Can I convert my tourist visa to a work permit in Malaysia?

No, converting your Malaysia tourist visa into a work visa is not allowed. Foreigners intending to work in Malaysia must obtain any one of the work visas: Employment pass or Professional visit pass.

What is JTKSM Approval Letter?

Amendments to the Employment Act 1955 which come into effect from 1st January 2023, requires employers to obtain prior approval from the JTKSM before applying all categories of foreign workers including expatriate.

Why do I need to post a job advertisement on MYFuturejobs?

Effective 1 Jan 2021, companies who are hiring foreign knowledge worker/expatriate are required to advertise the job vacancies on MYFutureJobs portal before applying for the Employment Pass with the Immigration Department. However, the authority (Ministry of Human Resource) may grant exemption to the applicants that fall under the categories as below:

  1. Expatriates with key roles in the company (e.g. C-suite, key positions).
  2. Expatriates with the monthly salary of RM15,000 and above.
  3. Expatriates who are hired as part of the set-up of Regional Office or Representative Office in Malaysia under the manufacturing and services sector to carry out activities for the company’s headquarters.
  4. Investors, shareholders and company owners – Investors are expatriates who invest funds in Malaysia to achieve returns on investments. Shareholders refer to expatriates who hold at least 30% equity shares and are appointed as the company’s Director and/or hold positions of interest in the company.
  5. 5.Corporate transfers, placements and trade agreements – Expatriates who are assigned by the parent company to work at the branch company in Malaysia or within the same group of companies.
  6. Employment Pass renewal applications – Renewals of Employment Pass Category I, II and III for approved positions.
  7. International Organisation – Organisations subject to the International Organisation Act (Privileges and Immunities).
  8. Sports Sector – Athletes/professionals joining any sports organisation/club in Malaysia.

If the applicant does not fall under the exempted category, then the Company is required to go through the recruitment process via advertisement of job vacancy at Myfuturejobs for a minimum of 14 days and submit the hiring report to obtain a recommendation certificate for hiring expatriates before submitting the Employment pass.

Do I need to register my company before applying for a work permit in Malaysia?

Yes, before you can sponsor foreign employees for work permits, your business must be legally registered with the Companies Commission of Malaysia (SSM)

Can MM2H be an alternative to a work visa?

The Malaysia My Second Home (MM2H) programme allows foreigners to reside in Malaysia long-term, but it is not a substitute for a work permit. Only MM2H Platinum Category Holders are able to work and invest in Malaysia.
