The Malaysian ESD Government Entity, – established in 2014 – , requires all Companies that wish to employ non-Malaysians (and therefore apply for a some form of Malaysian Work Permit) , – even temporarily -, to register with the Expatriate Services Division first. Upon approval from the Immigration Department of Malaysia, your company may apply for a range of Expatriate Visa or passes: Malaysia Employment Pass, Malaysia Residence Pass-Talent, Malaysia Professional Visit Pass, Malaysia Dependent Passes, Malaysia Long-Term Social Visit Pass, Malaysia Social Visit Pass (Temporary Employment)  and Foreign Maid Pass applications.

Is my company eligible to register with the ESD?

There are two requirements for ESD registration.

  1. The Company must be registered with either:
  • The Companies Commission of Malaysia (SSM) under Companies Act 1965 / 2016; or
  • The Registry of Societies Malaysia under the Organisation Act 1966; or
  • Associations/Cooperatives registered under the laws of Malaysia.
  1. The Company must comply with the requirements for “Paid-up Capital*” as shown below:

Foreign owned companies running Wholesale, Retail and Trade (WRT) where clearance from the Ministry of Domestic Trade, Co-operatives and Consumerism (MDTCC) is compulsory. RM1,000,000

How should our Company register with ESD?

Unfortunately, the process of ESD registration can be rather difficult and time consuming, if you are not fully familiar with all procedures and documents required by the Malaysian Immigration Department. On top of that, if your ESD registration is returned or rejected, it will take a few months to appeal again for it. If this appeal is rejected, your company will not be able to apply for employment passes or any other immigration related passes.

How long does it take to register with ESD?

Assuming the submission of all required documents is in order, ideally it takes fourteen working days for the registration process to be completed. However, if the Malaysian immigration department requires extra supporting documents, support letters or any other license from relevant agencies, the ESD Registration processing will take more time.
